Explanation of what an ACAN is: An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with award.
Project description: Rental of a mobile hydrogen refuelling station during the period leading-up to and including the 2010 OLYMPIC and Paraolympic Games held in Vancouver, British Columbia. This contract will cover the cost of renting the mobile refueller with additional storage, including all transportation costs, a highway barrier, a final report, a contingency fund of approximately 5% and the estimated hydrogen cost for use by Transport Canada. The capacity of the mobile refueller will be capable of filling both 350-bar and 700-bar vehicles, and must accommodate the hydrogen fuel requirements needed on a weekly basis. This refuelling station will be utilized by Transport Canada throughout the period of the rental contract. Other tasks included in this contract are: (a) providing ongoing monitoring of the refuelling activities to ensure a sufficient supply is available; (b) providing technical support and maintenance services on a 24/7 basis; (c) ensuring the station complies with all applicable codes and regulations, including obtaining all the necessary permits; (d) providing training and support to Transport Canada, including emergency response planning and training; and (e) ensure that the refueller is properly secured and that access is restricted to authorized personnel only.
Trade agreement application: The North American Free Trade Agreement applies to this proposed procurement.
Reason for single tendering consideration: To the best of our knowledge another company capable of providing this equipment for rent does not exist. We have consulted with the Canadian Hydrogen and Fuel Cell Association (CHFCA) and they have confirmed that Powertech Labs is the only supplier capable of providing a mobile refueling station with communication and non-communication capability fills of fuel cell vehicles at both the 350-bar and 700-bar. The CHFCA also stated that Powertech Labs is the sole hydrogen provider with the demonstrated experience in the fuel cell electric vehicle technologies that are present in this requirement. The refuelling station may require maintenance and support, which Powertech Labs can provide promptly. The refuelling station will be situated in the City of Vancouver's Yardworks facility. Given that Powertech Labs is a provincial entity, it has access to the Yardworks facility, and does not pose any further liabilities to the City of Vancouver. This requirement is crucial to the success of promoting Canada as a global leader in fuel cell technology on a world stage.

If you wish to submit a written response showing that you are capable of meeting this requirement, it must be done not later than the specified closing date and time. As it is intended to proceed in a timely manner, responses received after the closing date will not be considered.
Responses received on or before the closing date will be considered solely for the purpose of deciding whether or not to conduct a competitive procurement. Information provided will be used by the Crown for technical evaluations purposes only and will not be construed as a proposal. Your written response must provide sufficient evidence (e.g. Specifications, technical data, drawings or any other proof) that clearly demonstrates that your product or service is capable of fulfilling this requirement. Suppliers that have submitted a response will be notified in writing of PWGSC's decision whether to continue with the aforementioned procurement or to compete the requirement.

However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any procurement.
